Please read this privacy policy as our relationship with you in using the cotte-care.com e-shop is unconditionally governed by it (hereinafter referred to as “POS”).
Introductory provisions
1.These privacy terms and conditions apply to the use of the e-shop.
2.The provider and operator of the e-shop www.cotte-care.com is us – the company CELLTEX s.r.o., with registered office at Mokráň záhon 2, 821 04 Bratislava, ID No.: 31327052, registered in the Commercial Register of the District Court Bratislava I., Section: Sro., Insert No. 12679/B, established in the Slovak Republic (hereinafter referred to as “CELLTEX s.r.o.”).
3.The purpose of these Terms and Conditions is to inform you about the conditions under which you provide your Personal Data to CELLTEX s.r.o. and the manner in which CELLTEX s.r.o. handles the Personal Data it obtains about you.
4.Due to the fact that in order to make a purchase of goods through the e-shop it is necessary to provide CELLTEX s.r.o. Your Personal Data at least to the extent necessary to identify you as a contracting party (first name, last name, e-mail, billing address and telephone number), it is necessary for the use of the e-shop that you agree to the terms and conditions set out in this POS. However, before agreeing to these POS, we ask you to read them carefully and consider whether you agree to all parts of these POS, as by agreeing to these POS you agree to all parts of these POS. Should you disagree or be dissatisfied with any part of these POS, you may not approve these POS and use the e-shop.
For the purposes of this POS, the following terms shall have the following meanings:
“Pseudonymised data” means information and data about all users of the e-shop or individual categories and groups of users of the e-shop that has been anonymised and processed into a form that no longer allows a specific natural person to be identified without the use of additional data.
“Personal Data” means all information and data (which may include both personal data and special categories of sensitive personal data) relating to a specific natural person who is or could be identified through such data and which will be uploaded to the e-shop’s information system during the operation of the e-shop.
“Third parties” means persons other than CELLTEX Ltd and the Processors.
Processing of Personal Data
1.In connection with the creation of a customer account and/or the purchase of goods through the e-shop, it may be necessary to provide certain Personal Data to the extent that they are requested by individual forms in the context of ordering goods (e.g. name and surname, billing address, telephone number, e-mail, etc.). Any Personal Information you provide to us is voluntary and you are responsible for considering the extent to which you provide such Personal Information, however, without completing certain Personal Information you may not be able to create a customer account or place an order for goods
2.You are responsible for the accuracy, completeness and truthfulness of the Personal Data you provide and CELLTEX s.r.o. will rely on the accuracy, completeness and truthfulness of such Personal Data CELLTEX s.r.o. will not be liable for any damages that you or any third party may incur in connection with the provision of inaccurate, incomplete or untrue Personal Data when creating a customer account and/or placing an order for goods, or when you subsequently make changes to your Personal Data in the customer account interface or in an order
3.CELLTEX s.r.o. proceeds with the processing of Personal Data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and Act No. 122/2013 Coll. on the protection of personal data and on amending and supplementing certain regulations and other legislation.
Consent to the processing of Personal Data
1.You will be asked to provide your consent to the processing of Personal Data when you create your customer account and when you place an order for goods. You consent to the processing of your Personal Data by ticking the appropriate box on the form displayed in the browser you use when you create an order or register for a customer account.
2.By providing your consent to the processing of Personal Data, you grant CELLTEX s.r.o. your consent to the processing of your Personal Data to the extent that you have filled them in the individual forms, whether when creating an order or registering a customer account, but in particular the data that you fill in the respective form is mandatory, i.e. your first name, last name, billing address, e-mail and telephone number and, where applicable, delivery address.
Consent to the processing of Personal Data that also allows your indirect identification
a) information and data from the devices you use to use the e-shop, which may include general information about your device
b) log data, which is data and information that our servers automatically store whenever you access the e-shop (in particular, IP address, time of access, details of the hardware and software you use, the number of clicks, the pages you see or their order and the time you spend on the site, etc.);
c) data about your use of the e-shop and the transactions and deals you have made through the e-shop;
d) information obtained through cookies and other user monitoring devices, including cookies and monitoring devices of our business partners or social network operators, which we include in the e-shop at any time;
e) information obtained by monitoring users’ activities after clicking on an advertising banner or link, as well as information about activities on third party sites (such as search engines and social networks)
f)information we obtain through social plugins operated by third parties, such as the Facebook “Like Button” and similar.
Consent to the processing of Special Category Personal Data
1.Special categories of Personal Data are data revealing racial or ethnic origin, political opinions, religious beliefs, philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health or data concerning the sex life or sexual orientation of a natural person. These data cannot be processed by CELLTEX s.r.o. without your explicit consent.
Purpose of processing Personal Data
1.You provide the personal data referred to in this article of the POS to CELLTEX s.r.o. for the purpose of:
1. receiving, storing and processing them in the e-shop system and associating them with your order
2.their receipt, storage and processing for the purpose of processing your order;
3.communication with third parties in the processing of your order;
4.automatically filling in your Personal Data when you create an order after logging into your customer account;
5.direct marketing and profiling;
providing customer benefits;
6.displaying advertising that is relevant to you;
7.disclosing it to advisers, agents, auditors, attorneys of CELLTEX s.r.o. and other similar 8.persons in the resolution of any disputes or to comply with legal obligations;
9.providing technical support for the e-shop, its analytical and statistical processing, the 10.development of the e-shop, the prevention of abuse of the e-shop, the assessment of risks, the fulfilment of the conditions of generally binding legal regulations and the creation of Pseudonymised data.
The processing of personal data in our company for the purpose of sending newsletters occurs on the legal basis of the legitimate interest of the controller, since you have ordered something from our e-shop in the past, or have registered on it, or have at least expressed an interest in using our services, and therefore we reasonably assume that you are still interested in the information provided by us and the newsletters sent to you.
However, if you have decided that you no longer wish to receive our newsletters and emails in the future, it is your right to unsubscribe from receiving them by clicking on this link. Or also at any time by clicking on the link at the bottom of every email that our company sends you. This is your right and we can guarantee it 100%.
However, if you have decided that you want to continue to receive our emails and offers you do not need to take any action, just note the above information about the privacy system that we operate.”
Duration of your consent
1-You consent to the processing of Personal Data under this Article of POS for the duration of your customer account and/or for the time necessary to process your order and to comply with the contractual and legal obligations related to your order .
2.Your consent to the processing of Personal Data, which are Information whether you are expecting the birth of a child or whether you already have a child, Information about the expected date of birth of the child, your relationship to the child, is granted for a period of 4 years.
Withdrawal of consent
You may withdraw your consent to the processing of your Personal Data at any time by sending a written notice to CELLTEX Ltd. at the Company’s address listed above or by sending an email to shop@cotte-care.com
Processing of Personal Data for direct marketing purposes
1.Direct marketing is a method of marketing communication in which customers are contacted directly by direct mail, such as email, post, telephone, in person or targeted advertising.
2.Profiling is a form of automated processing of personal data consisting of the use of Personal Data to evaluate certain personal characteristics or characteristics relating to an individual, in particular to analyse or predict the characteristics or features of the data subject relating to his or her performance at work, financial situation, health, personal preferences, interests, reliability, behaviour, location or movements.
3.By consenting to the processing of your Personal Data, you also consent to the use of your Personal Data for direct marketing and profiling purposes.
4.You may object to the processing of your Personal Data pursuant to this Article of the POS at any time by sending a written notice to CELLTEX s.r.o. at the company’s address listed above or by sending an email to shop@cotte-care.com.
Your rights in the processing of Personal Data
1.You have the right to request confirmation from CELLTEX s.r.o. as to whether your Personal Data is being processed and to request disclosure of such Personal Data (CELLTEX s.r.o. may charge a fee for repeated disclosure of Personal Data) and information about
1.the purpose of the processing of the Personal Data;
2.the category of Personal Data processed;
3.the identification of the recipient or the category of recipient to whom the Personal Data has been or is to be disclosed, in particular a recipient in a third country or an international organisation, if applicable;
4.the period of retention of the personal data; if this is not possible, information on the criteria for determining it;
5.the right to request from CELLTEX s.r.o. the rectification, erasure or restriction of the processing of Personal Data relating to the data subject, or the right to object to the processing of Personal Data;
f. the right to initiate a personal data protection procedure;
g. the source of the Personal Data if the Personal Data was not obtained from you;
h. the existence of automated individual decision-making, including profiling, in particular information on the procedure used as well as on the meaning and foreseeable consequences of such processing of Personal Data for the data subject.
2.You have the right to request CELLTEX s.r.o. to correct incorrect Personal Data concerning you without undue delay and, having regard to the purpose of the processing of Personal Data, also the right to have your incomplete Personal Data completed.
3.You have the right to request CELLTEX s.r.o. to delete Personal Data concerning you without undue delay if:
1.They are no longer necessary for the purpose for which they were collected or otherwise processed;
2.you have withdrawn your consent to their processing;
3.you object to their processing;
4.your Personal Data has been unlawfully obtained,
5.the reason for erasure is the fulfilment of an obligation under this Act, a special regulation or an international treaty to which the Slovak Republic is bound; or
6.the Personal Data was obtained in connection with the offer of services of CELLTEX s.r.o.
4.You have the right to request CELLTEX s.r.o. to restrict the processing of your Personal Data if:
(a) you object to the accuracy of the Personal Data, for a period of time that allows CELLTEX s.r.o. to verify the accuracy of the Personal Data;
b) the processing of the Personal Data is unlawful and you object to the erasure of the Personal Data and request instead the restriction of its use;
c) CELLTEX s.r.o. no longer needs the Personal Data for the purpose of processing the Personal Data, but you need the Personal Data to pursue a legal claim.
5.You have the right to request CELLTEX s.r.o. to provide you with Personal Data relating to you in a structured, commonly used and machine-readable format, and the right to request that CELLTEX s.r.o. transfers this Personal Data to another controller.
6.You have the right to initiate a personal data protection proceeding before the Office for Personal Data Protection of the Slovak Republic.
7.You may exercise the rights exercisable under this Article of the POS with CELLTEX s.r.o. by sending a written notice of exercise of the right to the Company at the above address or to the email address shop@cotte-care.com.
Use of Personal Data and Pseudonymised Data
1.CELLTEX s.r.o. may disclose Personal Data to third parties (intermediaries) who supply goods and services to CELLTEX s.r.o. and to its consultants, agents, auditors, attorneys and other similar persons for the purpose of processing it in accordance with this POS. The aforementioned processors process personal data on the basis of a written contract with 2.CELLTEX s.r.o. and in compliance with the conditions for the protection of personal data (in particular, by observing professional, technical, organisational and personnel competence and guaranteeing security measures in accordance with the legislation) in accordance with the GDPR and Act No. 18/2018 Coll. on the protection of personal data, as amended.
2.CELLTEX s.r.o. may disclose Pseudonymized Data and other similar data and information about users to third parties and our marketing partners without restriction.
3.CELLTEX s.r.o. may also transfer, use and process Personal Data, Pseudonymised Data and other similar data and information about users to countries outside the European Economic Area, in particular the United States of America.
Security
1.All Personal Data and other data and information that we collect and process is protected by appropriate technical means and security procedures to prevent unauthorized access or misuse of such data. We continuously improve and implement new administrative, technical and personnel measures to ensure the security of Personal Data.
2.Notwithstanding any measures we take to ensure the security of transmitted data, it is important to remember that the transmission of data over the public network of the Internet or any storage of electronic data cannot 100% safe.
3.Portions of the e-shop may contain links to third party websites and services that are not owned or operated by CELLTEX s.r.o. CELLTEX s.r.o. has no control over those websites and services. These websites may use their own tools to collect information and data about you, including your Personal Information.
Cookies Policy
1.CELLTEX s.r.o. uses Cookies on the www.cotte-care.com e-shop to collect information about users. A cookie is a small data file that is stored on your device (e.g. mobile device or computer) when you use the e-shop and stores information about your devices, actions and settings for a certain period of time. The cookie will allow the e-shop to recognize you the next time you visit the browser or store your settings and other information. This is a common practice for most large websites.
2.You can control and/or delete cookies at your discretion – see the org for details. You can delete all cookies stored on your device. Your browser may allow you to set how it handles Cookies, including the ability to disable the use of Cookies altogether or to always ask you to consent to the use of a particular Cookie. Please note, however, that some parts of the e-shop may not work properly without the use of Cookies or some functionality may not be available at all.
3.CELLTEX s.r.o. may place Cookies on your device, and the information and data obtained from these Cookies is managed by these POS. CELLTEX s.r.o. may also allow our business partners and third parties to place Cookies (e.g. Google Analytics and others) on your device to enable these business partners and third parties to collect information about you.
4.We may use two types of cookies within the www.cotte-care.com e-shop, persistent cookies or session cookies. While session cookies are deleted when you close your browser, persistent cookies will remain on your device after you close your browser and will be used the next time you visit the e-shop.
5.The www.cotte.com e-shop may also use other tools for tracking and detecting user information with similar functionality (e.g. web beacons, Flash cookies, tracking URLs).
6.CELLTEX s.r.o. uses cookies and similar tracking tools for a number of purposes, in particular to:
1.making the e-shop and its functionalities available, operating them in the required quality and comfort for the user;
2.to make the e-shop and its functionalities accessible and operable on different websites, devices and browsers;
3.monitoring and analysing the performance, operation and efficiency of the e-shop and its improvement;
4.presenting content that is more relevant to the user;
5.preventing misuse of the e-shop and preventing and detecting fraudulent or otherwise inappropriate behaviour.
7.Our business partners and third parties use Cookies to enable them to better provide their services. They use cookies to track your behaviour when using the e-shop and to present you with advertisements for the Services directly on the e-shop or on third party websites, and also to prevent and detect fraudulent behaviour.
POS changes
1.We are entitled to change or modify this POS at any time.
2.Such changed POS will be valid and effective when posted on the Website and by using the e-shop (each visit to the Website) you agree to such new POS. You are obliged to familiarize yourself with the new POS before further use of the e-shop.
Final provisions
1.CELLTEX s.r.o. is entitled to assign or transfer the rights under this POS to any other person at any time. You are not entitled to transfer or assign any rights under this POS to a third party without the consent of CELLTEX Ltd.
2.This POS contains the entire and only agreement between you and CELLTEX s.r.o. with respect to the terms and conditions of your use of the e-shop and supersedes any prior written or oral agreements or understandings between you and CELLTEX s.r.o. with respect to the terms and conditions of your use of the e-shop.
3.No failure by CELLTEX s.r.o. to exercise any right or claim under these TOS shall constitute a waiver or relinquishment of such right or claim, and CELLTEX s.r.o. shall be entitled to exercise such right or claim at any time.
4.Should any provisions of this POS and the contract concluded between you and CELLTEX s.r.o. be invalid already at the time of its conclusion, or should they become invalid later after the conclusion of the contract, the validity of the remaining provisions of the POS shall not be affected. Instead of the invalid provisions of the POS, the provisions of the Commercial Code, the Copyright Act and other applicable legislation of the Slovak Republic which are closest in content and purpose to the content and purpose of the POS shall apply.
5.For the delivery of electronic messages (e-mail), an electronic document shall be deemed not to have been delivered until the addressee acknowledges its receipt by a return e-mail message (an acknowledgement of reading sent automatically by the e-mail client shall also be sufficient).
In the case of service of documents, the consignment shall be deemed to have been delivered even if the addressee refuses to accept it or even if the addressee, through his own fault or omission, fails to accept it. In such a case, it shall be deemed to have been delivered on expiry of the storage period at the post office, as determined by the sender, and on return of the consignment to the sender, of which the sender must provide undamaged proof. Notices delivered by a courier service shall be deemed to have been delivered at the time of receipt by the addressee. If delivery by courier service is unsuccessful, delivery shall be deemed to have taken place on the third day following the first attempted delivery, the attempted delivery being evidenced by a declaration by the courier service.
6.On the basis of these POS, a contractual relationship is established between you and CELLTEX s.r.o., which is governed by the law of the Slovak Republic. All disputes relating to claims arising out of or in connection with these POS or the use of the e-shop shall be exclusively within the jurisdiction of the courts of the Slovak Republic. Both you and CELLTEX s.r.o. agree that such disputes shall be subject to the jurisdiction of such courts.
